What keeps the Supreme Court from issuing a nationwide directive not to deport anyone until due process has occurred? It seems this hopping around federal jurisdictions is unduly time consuming.
Thank-you for this. I have some questions however. I don't understand how it is that the Trump administration can assert that the ruling by judge in Texas applies only to the named plaintiffs. Isn't the whole point of a class action that the named plaintiffs represent the entire class of plaintiffs? I also have a question about the people who have been shipped off to the prison in El Salvador. It seems that all of the focus is on Albrego Garcia based on the government's admission that it was an administrative error that caused his removal. But the denial of due process at issue applies irrespective of this admission by the government and it applies to ALL of the people removed in contravention of Judge Boasberg's order to bring them back (assuming the planes were in the air). Andrew, your discussion about the difference between civil vs criminal contempt focuses on the possible punishment for the parties who contravened Judge Boasberg's order. I would like to know what can be done to bring these people who were removed in contravention of their Constitutional right of due process back to the country for a hearing. CECOT is essentially a life sentence worse even than that imposed upon defendants on death row in this country. At CECOT inmates are deprived of seeing family members or consulting with a lawyer to make legal challenges to their detention. This cannot and must not stand not only with respect to Abrego Garcia but with regard to any of the people who were wrongly removed in contravention of their right to due process. There are several issues at stake here. First, whether they were subject to deportation at all. Second, even if shown to be affiliated with a notorious gang, whether removal is justified under the Alien Enemies Act. Third, even if you jump over the two preceding hurdles. under what authority can they be sent to a notorious prison in El Salvador (vs being sent to their country of origin) and be subject to what amount to the imposition of a life sentence without any opportunity to make legal challenges to their confinement . My apologies for this longwinded post and thank-you Andrew for any light that you can shed on these questions.
