This week’s episode discusses big picture and granular details of this week’s important legal developments.
Mary McCord and I discuss the ways in which the Supreme Court is sanctioning what has heretofore been been thought to be unlawful - whether seizing people in Los Angeles based on perceived racial or national characteristics and without sufficient factual cause, or killing people in a boat on the high seas. And by continuing to decide weighty matters without so much as a written opinion of explanation, the Supreme Court is giving a green light to the Administration’s widest possible interpretation of the law - leaving it free to trample on people’s rights. Apparently, it is too much to ask that the Court explains its reasoning and delineate what the government can and cannot do.
All is not bad news, though. We discuss the recent Harvard victory in a Boston district court, a Fifth Circuit decision finding the Trump Administration’s use of the Alien Enemies Act to be unlawful, and a new lawsuit challenging the Trump use of the National Guard in D.C.
We even mention the latest E. Jean Carroll win, which is normal times would be big news- the second appellate victory for the woman who has successfully sued Trump not once, but twice, for sexual assault and defamation, and won tens of millions of dollars as a result from two jury awards.
