The latest Main Justice episode with Mary McCord and me
This week, it’s all of a theme. Continuation of lawlessness. And while there is continued evidence of this by the administration, there are multiple examples of successful pushback to it.
Mary and I start by breaking down the decision this week by a federal district judge finding the interim US Attorney in the Eastern District of Virginia to be illegally appointed by the President. The court thus dismissed both the Letitia James and James Comey indictments on that ground. We discuss what to expect next, as the decision dismissed the cases “without prejudice.” What does that mean and what arguments do we expect the parties to make to any new charges (if/when they find a lawful prosecutor to re-institute the cases).
We then turn to the attack on Senator Mark Kelly for his role in a video in which he describes his view regarding the lawful duty of the military not to nfollow illegal orders. Trump and Hegseth take issue with that— I ask the question: why would they be doing that, when there is in fact a duty not to follow illegal orders? We discuss the various legal issues with what the administration is doing, and is now reporting to be doing with the other Members of Congress who also spoke along the same vein as Kelly in the video.
It all is one more step, in my view, in making America more like Russia.
Finally, we discuss the politically consequential redistricting cases in Texas and California- and what that tells us about the continued, blatant political weaponization of the Department of Justice.
