That is our new Main Justice episode on the Trump administration and Abrego Garcia
Seeking political retribution is far different than being able to prosecute a winning case, as the Trump administration is being forced to recognize. Mary McCord and I address how a grand jury, once again, refused to indict New York Attorney General Letitia James. This comes along with a ruling limiting what evidence might be used in the case against James Comey if the government seeks to re-bring that case based on a court finding the government violated the rights of Comey’s lawyer/friend Dan Richman.
But the main topic this week is the latest in the Kilmar Abrego Garcia saga. Federal District Judge Paula Xinis ordered his release. Her decision is a true “must read” (link below) given what she found the government did here: repeatedly violating his rights, violating her orders, and displaying no end of obfuscation and cruelty. It is very hard to recognize how we can claim to be a civilized country of laws in light of this litany of horrors.
Last up, we head to the West coast for an update on the National Guard deployment in L.A., and offer some analysis on Judge Bybee’s statement on 9th Circuit en banc review over deploying the National Guard to Portland, Oregon.
