Constitutional Showdown
The New Podcast Episode Of Main Justice – BTH, Vol 3.2.e
Last Friday, the President stood in the Great Hall of the Department of Justice, a space meant to embody the rule of law, and delivered a speech that can only be described as a political declaration wrapped in the trappings of a legal institution. It was an extraordinary moment, not just for what was said, but for what it signaled: a full-throated rejection of the post-Watergate norms that have long kept the DOJ independent from the White House.
That was just the beginning. Hours later, the administration invoked the Alien Enemies Act to order the removal of hundreds of Venezuelan migrants—just as a court issued an order blocking their deportation. What followed was a flurry of legal maneuvering, defiance, and a battle over whether the executive branch would comply with judicial authority.
On this week’s episode of Main Justice, Mary McCord and I break down the many layers of this moment: the unprecedented nature of the President’s speech, the legal and constitutional questions surrounding his use of the Alien Enemies Act, and whether the administration attempted to circumvent court orders in real-time. The situation got so dire that it prompted Chief Justice Roberts to speak out. And speaking of the Supreme Court, we turn to yet another high-stakes battle playing out there over the President’s executive order on birthright citizenship enshrined in the 14th Amendment.
At its core, this episode is about the future of the rule of law in America. When the executive branch tests the limits of its power, the courts are meant to be a check. But what happens when that check is ignored? Let’s get into it.

The thing is, if Justice Roberts didn't create the outrageous escape hatch for trump, we wouldn't be in this situation now. If the SCOTUS acted with speed on the tactical court delays trump kept using, he'd be in prison right now and not the White House.....The Roberts court has lost ALL of the dignity it ever possessed.
As an attorney, I have no respect for those Justices who flagrantly abuse all of the ethical standards any court must maintain. They've abused their positions and are complicit with that orange, lawless perpetrator, felon who calls himself "President".....Those "conservative" Justices are a disgrace to the profession. Furthermore, they outright lied during their respective confirmation hearings, regarding the issue of precedence and settled law. (Roe vs Wade).
It's a little late for Justice Roberts to add his "2 cents" into the dystopian hellscape that he helped create for the country. 😞
Thank you for sharing your wisdom, wit and experience with us, I look forward to your articles and videos... you always make me smarter.

Thank you for including transcripts. It is easier for me to absorb the intricacies in writing rather than spoken word.
